Terms and Conditions for Key Visuals Contest

These terms and conditions (“Terms”) are made effective as of the date of the submission of the application form attached hereto (“Effective Date”) by and between:

King Abdullah University of Science and Technology, a university of limited liability established under Royal Order number A/151 dated 20 ThulQi’dah, 1427 after Hijra (corresponding to December 11, 2006) by the Custodian of the Two Holy Mosques, King Abdullah bin Abdulaziz Al Saud, as an independent, non-profit academic institution organized and existing under the Laws of the Kingdom of Saudi Arabia, having its place of business at 4700 King Abdullah University of Science and Technology, Thuwal, Kingdom of Saudi Arabia 23955-6900,


The individual identified in the application form is attached hereto (“You”).

By participating in the Winter Enrichment Program (WEP) branding design competition (the “Competition”), you acknowledge that you have read and understood and agree to adhere to these Terms. KAUST reserves the right, at its sole discretion, to amend or change any of the Terms at any time without prior notice, and by participating in the Competition, you agree to these modified Terms.

1- Participation

1.1       To enter, you must visit the website, click on Key Visuals Design Contest, and complete the entry form with the required information, including your name, telephone number, and email address, and college or institution’s name and ID number.

1.2       KAUST reserves the right and at its absolute discretion to request certain information relating to your participation in the Competition, including proof of identity, age, and address.

1.3       Only applications through the website will be eligible for entry into the Competition. Other forms of entry will not be accepted.

1.4       You may only submit one application. Your application must comply with KAUST’s requirements and instructions, along with these Terms.

1.5       You must submit your design using your own email address submitted at the time of the application.

1.6       The design you submit to the Competition must be your own original work and must not include any elements you have not created yourself.


2- Duration

2.1       The Competition registration shall commence on June 1, 2022, at 08.00 a.m. until July 28, 2022, at 11.59 p.m. KSA time. Applications will not be accepted after this date.


3- Eligibility

3.1        The Competition is open to all students who are actively registered on a graphic design course at In-Kingdom universities and graduates in graphic design from In-Kingdom universities within the last 12 months.

3.2        Any entry shall be deemed void if your participation in the Competition conflicts with the laws of Saudi Arabia or with your institutions’ requirements. 

3.3        The following persons are not eligible to enter the Competition: employees of KAUST and their immediate family members (spouse, parent, child, sibling, and their respective spouses) or persons living in the same households of such employees, whether or not they are related.


4- Judging Criteria

1.1       The Judging Panel will select one winner and four runners up (collectively “the Winners”).

1.2       The Panel’s decisions as to any matter relating to the Competition, including but not limited to any application eligibility or choosing the Winners, will be final and binding. Participants have no right to appeal, contest or object to the Competition results.

1.3       The winner and runners-up shall be notified and publicly announced by the end of August 2022.


5- Prize

5.1       The winner shall receive a cash prize of SAR 5,000 (five thousand Saudi Riyals). 

5.2       The prize shall be transferred to the winner’s bank account by September 30, 2022.

5.3       The Winners will receive invitations to attend the Winter Enrichment Program and receive a certificate recognizing their achievement.

5.4       The winning design will be used on all branding materials prior to, during, and after WEP 2023.

5.5       The winner will not be entitled to more than one prize.


6- Exclusion from the Competition

6.1        KAUST reserves the right (without accepting any responsibility or granting You any compensation) to exclude You from participating in the Competition and/or withhold or withdraw the prize (at its sole discretion) in the event:

6.1.1     You violate these Terms at any time (whether it was discovered during or after the end of the Competition).

6.1.2     Your behavior was inappropriate or contrary to the spirit or the purpose of these Terms or the Competition.

6.1.3     You commit or carry out any fraud, breach of trust, deception, misconduct, or similar act, including providing any wrong or incorrect information;

6.1.4     Your participation was incomplete, incomprehensible, invalid, delayed, or in any way inconsistent with these Terms, any applicable laws, rules, or policies; or

6.1.5     You partake in any other conduct deemed worthy of exclusion from the Competition at KAUST’s sole discretion.


7- Limitation of Liability

7.1        You agree, acknowledge, and hold harmless and protect KAUST and its affiliates, officials, managers, employees, contractors, agents, and licensees from all liabilities arising from any claims, losses, damages, injuries, or disappointment as a result of your participation in the Competition or any activities related to the Competition, and the acceptance, use, misuse or possession of any prize granted in this Competition.

7.2        In the event that what is presented by You contains material or elements that You do not personally own and/or is subject to the rights of any third parties and/or if the likenesses of any individuals appear in it, You will be responsible for obtaining, prior to submitting your application, any necessary approvals to allow for the use and display of such elements.

7.3        You agree, acknowledge, and hold harmless, fully indemnify, and protect KAUST and its affiliates, officials, managers, employees, contractors, agents, and licensees from all liabilities pertaining to any violation of intellectual property rights, privacy, or any other rights of any third party.

7.4        KAUST will not bear any responsibility in the event that wrong or inaccurate information is provided or if human error, technical fault, loss, or delay in the transmission of data occurs.

7.5        You are not entitled to file a claim in connection with this Competition against KAUST or its affiliated entities to the extent that there is no direct contractual relationship between you and those entities. Your acceptance of these Terms does not constitute the creation of a direct contractual relationship between you and KAUST or its affiliated entities.

7.6        You undertake and warrant that all material submitted by you will not contain anything improper, defamatory, or contain defamation, obscene, offensive words, or harassment, or any material which can be construed as such under the laws and customs of Saudi Arabia.


8- The Right to Cancel or Suspend the Competition

8.1        If the Competition cannot be completed as planned for any reason out of KAUST’s control in a way that affects or prejudices the administration, safety, fairness, or integrity of the Competition or its proper implementation, KAUST has the right to cancel, end, suspend or amend the Competition without prior notice and without incurring any responsibilities towards any applicants or other third parties, including any decisions of the Panel and any monetary prize.


9- Intellectual Property Rights:

9.1        “Intellectual Property Rights” means any invention, design, utility model, trademark, service mark, business name, work which is the subject matter of copyright or related rights, industrial design, patent, know-how, trade secret, and any other intellectual property right of any nature whatsoever throughout the world (whether registered or unregistered and including all applications and rights to apply for the same).

 9.2      By registering in the Competition, you agree to and acknowledge the following:

9.2.1     The grant and transfer of all your rights, interests, and Intellectual Property Rights in all works submitted by you for the purpose of the Competition (including current and future copyrights), whether they are present or will exist in the future, to KAUST;

9.2.2     All intellectual property rights in any work created and submitted by yourself to the Competition are exclusively owned by KAUST;

9.2.3     You will sign all documents and do all other acts which KAUST requests to enable KAUST to enjoy the full benefits of this Section 9;

9.2.4     You will refrain from claiming ownership rights or any moral rights to the work which is the subject matter of copyright, or any derivative, compilation, sequel or series, or related work created by either yourself or KAUST in connection with the Competition or any subsequent event;

9.2.5     You have the right, power, and authority to grant the above rights and You have obtained all necessary approvals and authorizations to grant KAUST these rights.

9.3         For the avoidance of doubt, all rights granted in the name and ownership of the Competition and the Competition designs are the sole proprietorship of KAUST and can be used at KAUST’s sole discretion.

9.4       Acceptance of these Terms constitutes the necessary approval for KAUST to use, develop, or otherwise benefit from all or part of the work you submit. KAUST is not obligated to enter into a contract with you in order to do so. KAUST is also not obligated to use or develop any work submitted.


10- Confidentiality:

10.1     All personal data, including but not limited to your name and address, shall be processed as permitted under applicable law. KAUST will use this data to verify your identity and your eligibility to participate in the Competition.

10.2     You agree and undertake to maintain the confidentiality of any information you have received or may receive regarding KAUST, its business, or the Competition during your participation in the Competition as well as any outcomes that may ensue.


11- Announcements:

11.1     You agree that you will not disclose or publish onto any medium any information that You have received during your participation in the Competition or any work or information submitted by yourself until the issuance of the judgment and announcement of the Winners.

11.2     You may be asked to participate in promotional activities after completion of the Competition, and KAUST has the right to use or publish the Winners’ names, their likenesses and images, audio and/or video recordings of them in any advertisement, on social media, or any other form of media, whether for promotional purposes or otherwise, to the extent permitted by applicable law.


12- Costs:

12.1     You agree and understand that KAUST will not bear any financial costs on your behalf in relation to your participation in the Competition or during any stage thereof.

12.2     You acknowledge and agree that there are no fees paid by yourself in connection with your participation in the Competition.


13 - Governing Law and Jurisdiction:

14.1     These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or related to these Terms, its subject matter or its formation is subject to the laws of the Kingdom of Saudi Arabia and any disputes arising under or in connection with these Terms shall be settled before the competent courts in Jeddah, Kingdom of Saudi Arabia
